Meeting with NCSW and Council of Islamic Ideology on PLS of Inheritance Laws

19th October 2022 – WPC Office, Parliament House, Islamabad – Anthro Insights conducted a meeting in support to the Sub-Committee on Post-Legislative Scrutiny (PLS) with the Councilof Islamic Ideology and National Commission on the Status of Women (NCSW) dated 19th October 2022 to gather their insights on inheritance laws. Convenor of the Committee Ms. Wajiha Qamar, MNA, started the session where she put forward a thank you note and stressed the significance of post legislative scrutiny of inheritance laws for the benefit of public at large.

Thereafter, PLS expert Mr. Ali Mujtaba Zaidi from Anthro Insights precisely explained the purpose of conducting PLS of a law and how it can be used as an effective tool to enhance socio-legal engagement and to review the extent of delegated powers and functions under the law that is subject to revision. In response to this, the Council of Islamic Ideology shared their milestone achievement in successfully drafting and codifying the “Islamic Law of Inheritance, 2019” both in Urdu and English languages that could be used by the Judges and lawyers to correctly assess the inherited shares of the legal heirs. Furthermore, the Council of Islamic Ideology answered  questions of members of the Sub-Committee with respect to the shares of a Muslim woman and a Muslim as per different Schools of thought and according to different situations.

Similarly, the representatives of NCSW shared experiences regarding inheritance related issues that have been reported to it over the time. It was stressed by NCSW that first step to the implementation of any law is to make people aware of the legal protection and application of the rights that are explicitly explained in a definite piece of legislation. It was concluded that both institutes will share more insights particularly keeping in view the awareness, citizens’ engagement and implementation related problems.
